Should I let the seller stay after closing—and should I charge rent?

by Alessandra Imanabadi

A seller who needs time to move has told you something useful. In a Bay Area purchase, solving that problem may be worth more to them than another increase in price.

First, have your agent assess the seller and the situation. If they are comfortable recommending it and the timing works for you, our answer is yes. You now know something valuable: what the seller needs.

There are times we recommend offering those 60 days without charging rent

Why? Suppose comparable rent would be $5,000 a month. Two months represents $10,000. On a high-value purchase, that accommodation may make your offer more appealing than spending substantially more on the price. The seller gets breathing room, avoids moving twice, and sees a buyer willing to work with them. You gain a negotiating advantage by solving a problem that matters to them.

But we do not recommend the same arrangement with every seller

There are situations where we are less comfortable with the circumstances and recommend market rent, a security deposit within applicable legal limits, and a written agreement covering possession, damage and a delayed move-out. Even when the stay is free, the agreement should clearly address the move-out date, property condition, and what happens if the seller remains beyond day 60. Your lender and insurer also need to accept the arrangement. The best negotiation gives both sides a reason to say yes. Understand what the seller wants, decide what you can comfortably offer, and use that knowledge to build a deal that works for both of you.

Speak with Alessandra about your situation. We will help you identify what matters, what deserves a closer look and the next step that fits your plans.
