Should I buy a tenant-occupied Bay Area home if I want to move in?
The purchase price may look attractive. But if you are buying a home for your family, the first question is whether you can actually move in when you need to.
If you are buying it to move into, our advice is firmly no—not while your move depends on getting the tenants to leave. You may hear, “We already gave them notice.” That is not the same as delivering a vacant home. A notice does not guarantee they will leave by your closing date. Cities such as San Francisco, Oakland and Berkeley also have local tenant protections that can limit or delay a move-out. Do not let that reassurance turn the seller’s unresolved situation into your responsibility. If the agreement is to deliver the home vacant, our recommendation is to verify that it is actually vacant before closing.
If this is an investment property, the conversation is different
Existing tenants can provide income from day one. Review the leases, actual rent collected, payment history, deposits, expenses, and any disputes. Compare the purchase price with the income it produces today—not higher rents you hope to collect later. Buy your own home knowing you can move in. Buy an investment knowing exactly which tenancy and income you are taking over.
Check the rules for the actual address
A purchase in San Francisco, the East Bay, the Peninsula or San Jose should not be evaluated using another city’s rules. Before relying on a vacancy plan, have the tenancy and the applicable requirements reviewed. Our recommendation remains simple: if you need the home to live in, verify vacant possession before closing.
